"Measuring instruments which
1. are not eligible for CE marking, EC type approval or EC initial verification, and
2. have been lawfully placed on the market in a Member State of the European Union or a contracting state to the Agreement on the European Economic Area, in Switzerland or in Turkey,
may also be placed on the market within the scope of this Act if the accuracy, stability and verifiability of these measuring instruments are guaranteed in an equivalent manner to those of measuring instruments placed on the market in accordance with this Act.

The competent authorities shall, when carrying out an equivalence assessment of measuring instruments within the meaning of paragraph 1, comply with the provisions of Regulation (EU) 2019/515 of the European Parliament and of the Council of 19 March 2019 on the mutual recognition of goods lawfully marketed in another Member State ...
